1. Acceptance of Terms

By accessing or using the Application, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any part of these Terms, you must discontinue use of the Application immediately.

2. Intellectual Property & Licence

1. Ownership: All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.
2. Licence Grant: We grant you a limited, non-exclusive, revocable, non-transferable licence to use the Application on any compatible device that you own or control, solely for personal, non-commercial purposes.
3. Restrictions: You agree not to:
   • Copy, modify, or distribute any portion of the Application.
   • Attempt to extract the source code, decompile, or create derivative works of the Application.
   • Reproduce or use the Service Provider's trademarks without our express written permission.

3. Freemium Service & In-App Purchases

1. Freemium Model: The Application is provided on a freemium basis. Certain features or functionalities may only be available through in-app purchases or subscription plans.
2. Pricing & Changes: The Service Provider reserves the right to amend pricing, introduce fees for services, or modify subscription plans at any time. Any such changes will be communicated to you in advance.
3. Free Trials: If a free trial is offered, it is your responsibility to cancel before the trial ends if you do not wish to be charged for the subscription or paid service.

4. Personal Data & Privacy

1. Data Collection & Use: To provide the Service, the Application may store and process personal data that you submit. For details on how we handle your data, please refer to our Privacy Policy.
2. Third-Party Services: Parts of the Application rely on third-party services. By using the Application, you also agree to any Terms & Conditions and Privacy Policies imposed by these third parties. Currently, we utilise:
   • Proxed.AI
   • OpenAI
   • Openpanel
   • RevenueCat

5. Device Security & Usage

1. Security: It is your responsibility to maintain the security of your device and its access to the Application.
2. Rooting/Jailbreaking: We strongly advise against jailbreaking or rooting your device. Removing official operating system restrictions can:
   • Expose your phone to malware, viruses, and other malicious programs.
   • Compromise your phone's security features.
   • Prevent the Application from functioning properly, or at all.
3. Internet Connectivity: Some functionality of the Application may require an active internet connection. The Service Provider cannot be held responsible for lack of functionality caused by limited or interrupted internet access.

6. Third-Party Costs & Charges

1. Mobile Data & Charges: Your mobile network provider's standard rates and fees may apply while you use the Application, especially if you are not connected to Wi-Fi. You accept responsibility for any such charges, including roaming fees.
2. Billing Responsibility: If you are not the bill payer for the device on which you use the Application, you warrant that you have received permission to incur potential data or usage charges.

7. Limitations of Liability

1. No Warranty: Although we strive to provide accurate and up-to-date information within the Application, we rely on data from third parties and AI-based models. We make no representations or warranties regarding the Application's accuracy, reliability, or suitability for any specific purpose.
2. Indirect Losses: The Service Provider shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or relating to your use (or inability to use) the Application, including but not limited to loss of data, lost profits, or device damage.
3. User Responsibility: It is your duty to ensure your device remains sufficiently charged and that you understand reliance on any information or features of the Application is at your own risk.
4. Force Majeure: We shall not be held responsible for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, internet failures, or external service disruptions.

8. App Updates & Availability

1. Updates: We may periodically release updates to enhance or fix the Application. You agree to download and install these updates when prompted. Continued use of the Application may be conditional upon installing updates.
2. Discontinuation: We may cease providing the Application at any time, with or without notice. Upon any termination, all rights and licences granted under these Terms will end immediately, and you must cease using the Application and remove it from your device.

9. Changes to These Terms

1. Revisions: The Service Provider may revise or update these Terms at any time. We will notify you of any major changes by posting the updated Terms on this page or within the Application.
2. Acceptance of Changes: Your continued use of the Application after changes have been posted constitutes your acceptance of the new Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. You agree that any disputes or proceedings arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
